A doctor trained at a private university obtained in court the right to receive a discount on A balance of approximately R$ 400,000 due to the Student Finance Fund (FIES). The decision was made by Federal Judge José Jacomo Jiménez, of the First Federal Court in Maringá, north of Paraná.

The professional’s justification for requesting the reduction was that he worked in the Unified Health System (SUS) during the pandemic. The decision may be appealed.

In the ruling, the judge highlighted that the right to deduct the balance owed to doctors, nurses and other health professionals working within the scope of the SUS during the validity period of the health emergency resulting from the Covid-19 epidemic is provided by law.

The Federal Court decided that in the case of doctors, the discount would be 25%. According to the plaintiff, his outstanding balance exists 394,445.80 Brazilian reals.

According to the court, the doctor requested a discount for 25 months, claiming that he worked as a doctor on the front lines to combat the epidemic during that period.

However, the National Fund for Educational Development and the union argued that the 1% reduction for each month of work during the period of the health emergency resulting from the pandemic must take into account the period of validity of the legislative decree dated March 20, 2020.

“In view of the declarations of the author’s professional history contained in the National Center for Economic Studies, and in view of the closure of the health emergency resulting from the Covid-19 epidemic declared by Order No. 913 of April 22, 2022 issued by the Ministry of Health, the reduction percentage that should be implemented in the author’s contract is FIES 25% of the consolidated outstanding balance as of July/2023 (the date of the administrative request), for the period from March/2020 to April/2022, according to the preliminary petition estimate,” the judge concluded.
