This Friday (8), UOL’s Splash News reported that Dado Dolabella had his driver’s license and passport confiscated by the Rio de Janeiro Court of Justice. The artist will have a debt of R$450,000 related to the rent of a penthouse apartment where he used to live. In response, the singer’s defense spoke on Saturday (9) about the case.

To the team at Hugoloss.com, lawyer Fernanda Tribaud responded to UOL and declared that the information in this process is confidential from the courts. Moreover, he stressed that “religion must be discussed within a procedure, respecting due process and without malicious accusations, being an illegal act in the legal system.” The defense also revealed that Dolabella had obtained a court order to stop the case, but that he was “prepared to resolve the matter, after resolving the procedural irregularities and presenting his defence.”

The judge in charge of the case acknowledged the lower court’s error in not citing Daddo correctly, which made it impossible for the artist to defend himself. As a result, the process continued without the defendant’s participation. In this way, even if a final judgment is rendered against the winner of “A Fazenda”, the process will still be invalid.

“For the procedure to be valid, it is required that the defendant or respondent be summoned unless the initial request is rejected or the request is initially dismissed.”says Article 239, head, of the Code of Civil Procedure.

Regarding the driver’s license and passport, the lawyer said that she had not yet been notified or notified of this decision, which was to be issued by Judge Alexandre de Carvalho Mesquita, of the city’s Fourth Commercial Court, last Tuesday (5). According to Tribaud, if the decision is indeed reached, it will file an appeal, seeking the suspension of the decision and the invalidation of the procedure, due to the procedural irregularity (the respondent’s citation) recognized by Judge Dr. Renata Silvares France, of the 12th Chamber of Private Law of the TJRJ.
